Abstract

In England and Wales, the Mental Capacity Act 2005 (MCA) introduced a legal framework for the regulation of decision making on behalf of adults who are found to lack capacity to make decisions for themselves. The five principles of the MCA require interpretation during application, which poses a challenge to practitioners who are using the legislation in practice. Research has demonstrated inconsistencies in the implementation of the MCA, which undermines the rights of service users the legislation was designed to uphold. This research provides a literature review of relevant studies, including an analysis and synthesis of five research articles. It seeks to uncover the subjective experiences of practitioners themselves to gain insight into the nuanced challenges presented when implementing the MCA in practice. It will then provide recommendations to improve practice based on the findings, and suggest possibilities for future research.
