Abstract

This research paper focuses on the judiciary's role in Nigeria's Presidential election since the fourth republic (i.e., 1999 to 2023). The study examined the perception of the Judiciary and its constitutional role especially in election petition resolution with cognisance to theoretical review on judicial interventionism. The perception of the Judiciary and its constitutional role was considered and analysed from theoretical and empirical approaches to judicial interventionism in election-related matters. The Presidential election and related petitions in Nigeria were focused on since the fourth republic, with further analysis and comparison with what is obtainable in some other African countries like Ghana, Zambia and Zimbabwe. The dissertation findings on the Judicial interventionism on Presidential election petitions since the fourth republic depict that the Judiciary's judgement on Presidential election petitions and in Africa has been following the same trends as the Judiciary through the court has failed to discharge its judgement independently especially when the petition is against the ruling or elite group. Furthermore, a focus on the concluded Nigeria 2023 presidential election which has given rise to several petitions from the opposition candidates and political parties was done to see if there is any evidence of formal judicial position trends or if there is a better turnaround. The Presidential Tribunal court is presently still presiding over these petitions, with several petitions having been dismissed and hope the Tribunal will to decide and pass its final judgement on the 2023 Presidential election result in a fair and unbiased manner.
